Our lawsuit regarding the political ban will not be limited to the National Movement. Some of the former members of the National Movement are in another party today, but they should be held politically responsible for yesterday’s crime, – said the Speaker of the Parliament, Shalva Papuashvili.
As he explains, there was a certain legislative gap when there was no legislative basis for the responsibility of politicians for unconstitutional actions.
“In general, it is an international standard, which was not regulated in our legislation before, you know, it was determined only to prohibit the activities of the party, but the party is not a legal form, the unconstitutionality of the party is determined by those people who are the ideologists and rulers of the party. Accordingly, this was a certain legislative flaw in our country. So, the establishment of exactly this standard becomes logical and understandable, that if the party is unconstitutional, if the party incites strife, if the party violates territorial integrity, if the party acts against the constitution, it acts not as a legal entity, but as the people who determine the actions of the party. So, this is a significant change,” Papuashvili said.
He also spoke in detail about the constitutional lawsuit, which will be ready in a few days.
“A constitutional lawsuit is being prepared, in which we indicate who we mean, or in our opinion, which parties are violating the constitution and should be declared unconstitutional… As part of our lawsuit, of course, there will be a list of individuals who we believe were and are decision-makers and have relevant political influence on the party and, in general, on the political platform of this party. This will be part of our lawsuit,” Papuashvili said.
When asked who is compiling the list of individuals, the Speaker of Parliament replied that “the list will include people who had or still have a decisive influence on the political decisions of a specific party.”
“This is part of the law, then, in the lawsuit, the claim will be written down those parties that we think are violating the constitution, and those individuals whose political party membership and other such activities will be restricted. Of course, this does not mean all party members, I don’t know how many members the National Movement has, but we agree that there will be several hundred members, it is important that there are people who had or still have a decisive influence on the political decisions and activities of a specific party. Our lawsuit regarding the political ban will not be limited to the National Movement. He also said that last year, “1,120,000 people supported the filing of a constitutional lawsuit against the parties violating the constitution.”
