Deputy Minister of Justice Beka Dzamashvili said that the amount imposed by the Washington arbitration on the Khazaradze-Japaridze partner has already been reflected in the Georgian budget.
According to him, the immediate payment clearly shows that “they knew from the beginning that the failure to implement the Anaklia project was not the state’s fault.”
“Paying the imposed amount confirms that they agree with the arbitration decision, that is, that the failure to implement the Anaklia project was entirely their fault and the state did not interfere with them. When a person knows that he is right, of course, uses all legal mechanisms, he would definitely appeal and try to defend his truth to the end, but the immediate implementation of this decision confirms that they knew from the very beginning that the state was right in this case. They simply used these cases to receive certain political dividends. They filed a case in two different arbitrations and it is noteworthy that last year, when the Paris arbitration made a decision against the Anaklia consortium, they did not appeal this decision and all this together shows that they needed these cases for political reasons,” said Beka Dzamashvili.
According to the Deputy Minister, all steps taken by the state were aimed at saving costs, however, the other side was deliberately trying to cause financial losses to the state.
“It is natural that when the state is sued for damages exceeding 4 billion, the state is obliged to defend itself and bear the corresponding costs. In fact, it can be said that the several tens of millions that the state needed to conduct this dispute are on their shoulders, because we made many offers during the dispute process so that these costs would be saved for everyone. We proposed that the dispute be conducted in only one arbitration, but they wanted to conduct these disputes in parallel, and this is also very clear what their goal was – to cause maximum damage to the state. In total, because they started these two disputes in Washington and Paris arbitration in parallel, the total cost, 63 million GEL, was a loss to the state budget,” said Beka Dzamashvili.
