Georgian Judiciary Fails to Grant Mzia Amaghlobeli Right to Review Unlawful Imprisonment

The Kutaisi Court of Appeals has made another illegal and repressive decision, according to the Young Lawyers’ Association (GYLA). The court refused to accept a complaint in the case of journalist Mzia Amaghlobeli.

Mzia Amaghlobeli was detained on January 12. Her defense lawyers presented new evidence, including video footage that shows she was unlawfully detained through administrative procedures. They also pointed out that all the materials provided by the prosecution were based solely on statements from law enforcement officials.

The court was provided with a record of Mzia Amaghlobeli’s interrogation and the video footage of the incident. However, Judge Vera Dolidze ignored the legal requirements and deemed the defense lawyers’ complaint inadmissible.

GYLA stated that the decision is another example of the Georgian judiciary failing to grant Mzia Amaghlobeli her right to review her unlawful imprisonment. The court did not consider or assess any of the arguments presented by the defense, and Judge Dolidze did not justify why she considered any new substantial evidence presented by the defense to be irrelevant.

This is the second time the Kutaisi Court of Appeals has declined to hear the case. GYLA concludes that the decision is yet another illegal, repressive, and legally flawed act, which reaffirms that the Georgian judiciary did not grant Mzia Amaghlobeli her right to review her unlawful imprisonment.
