Lawyer Eka Beselia visited Elene Khoshtaria, one of the leaders of the Coalition for Change, in the temporary detention center of Zahesi.
As Eka Beselia stated, there was no unethical, illegal or disrespectful attitude towards Elene Khoshtaria. She also spoke about the investigation launched against Elene Khoshtaria and stated that the grounds for the detention are illegal, as there is no wording in the Criminal Code that writing on a banner is a criminal offense.
“I visited Elene Khoshtaria. First of all, I wanted to get information about her health and see the conditions. She feels strong and hopeful. To be objective, it should be said that she did not express any concerns about the conditions, she said that she was being treated normally and there was nothing unethical, illegal or disrespectful towards her. The only problem was the restriction of correspondence.
The grounds for the detention are illegal, she has not yet been charged, the detention is illegal under criminal law, because there is no wording in the Criminal Code that an inscription on a banner would give rise to the initiation of a criminal investigation. People were mutilated, beaten to death and no investigation has been initiated into this, and such a thing, which is within the limits of expression or beyond its limits, is a matter of discussion, this is a constitutional standard and has nothing to do with the article of the Criminal Law under which the investigation was initiated. Elene is waiting to see what the next steps will be from the investigation. She is right in thinking that she did not commit a crime. Indicting her under this article would be a violation of the Constitution, the Convention and the Code, and I hope that those people who are now thinking about formulating charges will have the sense.
Indicting her will be an illegal procedure. It is even funny when we talk about it, especially in light of the crimes that have occurred, but if they still decide to indict her, the next political decision will be what type of preventive measure they will demand. They cannot introduce a practice that directly tells us that this is political revenge, and I hope that the decision-maker will have the sense,” said Eka Beselia.
For information, one of the leaders of the Coalition for Change Elene Khoshtaria will be charged in the Zahesi temporary detention center today. Her lawyer Shota Tutberidze will also attend the procedure. After that, the court will discuss the imposition of a preventive measure.
On September 14, Elene Khoshtaria wrote the inscription “Russian Dream” on the banner near Kakha Kaladze’s election headquarters. She herself shared the corresponding video on social media and stated that in this way she expresses solidarity with Megi Diasamidze, who was arrested a few days ago for damaging Kakha Kaladze’s election banner.
