**New Prosecutor General to be Elected by Parliament**
In a move aimed at ensuring transparency and fairness, the new Prosecutor General will be elected by the Georgian Parliament. This significant step comes after the Prosecutorial Council selects candidates through a rigorous consultation process.
**The Selection Process Begins in the Prosecutorial Council**
According to the Law on the Prosecutor’s Office, the Prosecutorial Council starts a one-month consultation process six months before the term of the current Prosecutor General expires or in case of early termination. This inclusive approach involves academic circles, civil society representatives, and law experts. The goal is to identify at least three highly qualified candidates for the position.
**A Fair Voting Process**
Each candidate undergoes a separate vote by secret ballot during a session of the Prosecutorial Council. To be elected, a candidate must receive the most votes, but no less than two-thirds of the full composition of the Council’s support. If two or more candidates tie in votes, the Chairperson’s vote is decisive. In cases where no candidate meets this threshold, a second round is held between the top two contenders.
**A Second Round of Voting**
If the second round also fails to yield a candidate with at least two-thirds of the Council’s support, the Prosecutorial Council must nominate new candidates within one week using the same procedure. This process ensures that only highly qualified individuals are considered for the position.
**Submissions and Justification**
Once the selected candidate is chosen, they will be submitted to Parliament by the Prosecutorial Council with a thorough justification of their qualifications. This process aims to demonstrate transparency and accountability in selecting the next Prosecutor General.
As a side note, current Prosecutor General Giorgi Gabitashvili has been nominated for the position of Auditor General by Parliamentary Speaker Shalva Papuashvili. The path forward for him remains uncertain amidst this new election process.
