 Parliament will review another new legislative package related to persons convicted of financial crimes in an accelerated procedure on October 15.
The Legal Affairs Committee, followed by Parliament in a plenary session format, will discuss the planned amendments to the “Criminal Procedure Code,” the Law “On the Procedure for Leaving and Entering Georgia for Georgian Citizens,” the Law “On Crime Prevention, Execution of Non-Custodial Sentences, and Probation,” and the Law “On Enforcement Proceedings.”
Under the legislative package, persons convicted of certain financial and economic crimes will be prohibited from leaving the country until they fully compensate the damage.
Additionally, under the law adopted in September and still in effect, persons convicted of financial crimes are prohibited from leaving Georgia by a court conviction, and the ban on leaving the country is only applied through a court conviction. Under the new bill submitted to Parliament, however, the convicted person will be banned from leaving Georgia without a specific mention in the court conviction.
Parliament adopted a law on September 3 in the third reading that restricts persons convicted of financial and economic crimes from leaving Georgia and prohibits them from leaving the country for 16 years.
A convicted person required to compensate damage will be obligated to wear an electronic bracelet, and their property, as well as that of their family members, may be confiscated and transferred to the benefit of the victim.
Under the same law, the convicted person is prohibited from possessing more than twice the subsistence minimum until the damage is compensated; transferring money or property to such a person will be considered a separate crime and punishable by a fine or up to five years’ imprisonment.
The authors and initiators of the bill are members of “Georgian Dream”: Archil Gorduladze, Tornike Cheishvili, Alexandre Tabatadze, Davit Matikashvili, Rati Ionatamishvili, Aluda Gudushauri, Tengiz Sharmanashvili, Guram Macharashvili, and Akaki Aladashvili.
